Terms and Conditions
Introduction
These Terms and Conditions ("T&Cs") govern bookings and participation in day tours provided by Aesplore (Pty) Ltd, trading as Design Safaris ("Design Safaris"). By booking or participating in our tours, you agree to these T&Cs.

Bookings and Reservations
2.1. A booking is confirmed once full payment or, in the case of group bookings, a deposit is received.
2.2. Once confirmed, the booking constitutes a binding contract between the customer and Design Safaris.
2.3. Customers are responsible for reviewing all booking details for accuracy and notifying Design Safaris immediately of any errors.Payment Terms
3.1. Full payment is required at the time of booking to secure participation.
3.2. For group bookings of five or more participants, a 30% non-refundable deposit may be paid, with the balance due 14 days before the tour date.
3.3. Failure to make payment within the specified deadlines may result in cancellation of the booking without further notice.Cancellations by the Customer
4.1. All cancellations must be submitted in writing via email or WhatsApp.
4.2. Refunds are determined by the notice period before the tour start time:
More than 24 hours before the tour start time: 100% refund
Less than 24 hours before the tour start time or no-shows: no refund
4.3. In accordance with the Consumer Protection Act (CPA), Design Safaris may, at its discretion, consider partial refunds for cancellations caused by serious unforeseen circumstances such as hospitalization or bereavement, less unrecoverable costs.
Cancellations or Changes by Design Safaris
5.1. Design Safaris reserves the right to cancel or reschedule a tour due to weather, safety concerns, vehicle issues, staff illness, or other events beyond its control (force majeure).
5.2. In such cases, customers will be offered a full refund, a rescheduled tour, or a credit for future use.
5.3. Design Safaris is not responsible for additional expenses incurred by customers due to cancellations, including but not limited to accommodation, flights, or transport.Liability and Indemnity
6.1. Guests acknowledge that participation in tours involves inherent risks, including travel by vehicle, walking tours, and visits to third-party venues.
6.2. By booking, guests voluntarily accept these risks and agree that Design Safaris, its directors, employees, contractors, agents, and representatives are not liable for any injury, illness, loss, damage, delay, or expense arising from participation in the tour.
6.3. Services provided by independent third parties, including restaurants, transport, and venues, are the sole responsibility of those providers. Design Safaris does not accept liability for acts, errors, or omissions of third parties.
6.4. Guests are responsible for their own conduct during the tour. Disruptive, unsafe, or unlawful behaviour may result in removal from the tour without refund, and any resulting costs are the responsibility of the guest.Travel Insurance
7.1. While not mandatory for day tours, Design Safaris strongly recommends travel insurance to cover cancellations, medical emergencies, personal injury, or lost belongings.
7.2. Design Safaris is not liable for expenses that could have been covered by travel insurance.Itinerary and Timing
8.1. Itineraries may change due to operational needs, traffic, weather, or safety reasons.
8.2. Customers must arrive at the designated meeting point on time. Late arrivals may result in missed tours without refund.Customer Conduct
9.1. Guests are expected to behave respectfully towards staff, other participants, and third-party service providers.
9.2. Design Safaris reserves the right to remove any guest behaving in a disruptive, unsafe, or unlawful manner without refund.Complaints
10.1. Concerns should be raised with staff during the tour so they can be addressed promptly.
10.2. Formal complaints must be submitted in writing within 7 days of the tour date.Data Protection
11.1. Design Safaris complies with the Protection of Personal Information Act (POPIA).
11.2. Personal information is collected solely for operational and booking purposes and will not be shared with third parties except where required to deliver services.Force Majeure
12.1. Design Safaris is not liable for cancellations, delays, or changes caused by force majeure events, including natural disasters, strikes, pandemics, or road closures.
12.2. In such cases, a refund, credit, or rescheduling option will be provided, less unrecoverable costs.Governing Law
13.1. These T&Cs are governed by the laws of South Africa.
13.2. Any disputes shall be resolved in the jurisdiction of South African courts.Contact Information
