Terms and Conditions
Introduction
These Terms and Conditions ("T&Cs") govern bookings and participation in day tours provided by Aesplore (Pty) Ltd, trading as Design Safaris ("Design Safaris"). By booking or participating in our tours, you agree to these T&Cs.

1. General Terms
1.1. These T&Cs apply to all bookings made directly with Design Safaris or through third party platforms.
1.2. By booking, you confirm that you have read, understood and accepted these T&Cs on behalf of yourself and all persons included in the booking.
1.3. Design Safaris may update these T&Cs at any time. The version in effect at the time of booking applies.
2. Booking and Confirmation
2.1. A booking is confirmed once full payment is received and written confirmation issued.
2.2. The person making the booking warrants that they have the authority to act on behalf of all participants.
2.3. Accurate personal details, including relevant medical or mobility information, must be provided.
2.4. Design Safaris may refuse a booking at its discretion.
3. Payment Terms
3.1. Full payment is required at the time of booking unless otherwise agreed in writing.
3.2. Private groups of five or more may secure a booking with a 30 percent non refundable deposit, with the balance due 14 days before the tour.
3.3. Failure to pay the balance by the deadline constitutes cancellation by the customer.
4. Customer Cancellations
4.1. All cancellations must be submitted in writing via email or WhatsApp.
4.2. More than 24 hours before the tour: 100 percent refund.
4.3. Less than 24 hours before the tour or no shows: no refund.
4.4. Late arrivals, missed meeting points, illness, flight delays or personal emergencies are not grounds for refunds.
4.5. Refunds outside these rules are at the sole discretion of Design Safaris.
5. Cancellations or Amendments by Design Safaris
5.1. Design Safaris may cancel or amend a tour due to weather, safety concerns, vehicle issues, staff illness, venue availability or force majeure events.
5.2. If Design Safaris cancels a tour, guests may choose a full refund, credit or rescheduled date.
5.3. Design Safaris is not liable for consequential or incidental costs including accommodation, meals, flights or transport.
6. Participation Requirements
6.1. Guests must be medically and physically able to participate in the tour activities.
6.2. Tours may involve walking on uneven surfaces, stairs, hills, vineyards, narrow pathways and active workshops with tools or machinery.
6.3. Guests must disclose relevant medical conditions, allergies or mobility concerns before booking.
6.4. Design Safaris may refuse participation if a guest is intoxicated, disruptive, unsafe or poses a risk to themselves or others.
6.5. Minors must be accompanied by a responsible adult who assumes all liability for them.
7. Liability, Risk and Indemnity
7.1. Participation involves inherent risks including transportation, uneven ground, weather exposure, workshop environments and alcohol tastings.
7.2. Guests participate voluntarily and at their own risk.
7.3. To the fullest extent permitted by South African law, Design Safaris, its directors, employees, contractors and agents are not liable for injury, illness, death, loss, theft, damage or expenses arising from participation.
7.4. Guests indemnify Design Safaris from claims arising from their own conduct, negligence or breach of the T&Cs.
7.5. Services provided by third party venues, restaurants, drivers or suppliers are independent. Design Safaris is not responsible for their acts or omissions.
8. Alcohol Consumption
8.1. Alcohol is consumed only at designated venues.
8.2. Participation in tastings is voluntary and at the guest’s own risk.
8.3. Design Safaris may refuse service if a guest shows signs of intoxication.
9. Food, Allergies and Refreshments
9.1. Design Safaris may provide water, refreshments and small snacks.
9.2. Guests must inform Design Safaris of allergies before the tour.
9.3. Design Safaris is not liable for allergic reactions or food sensitivities.
10. Personal Property
10.1. Guests are responsible for their belongings throughout the tour.
10.2. Design Safaris is not liable for loss, theft or damage to personal items.
11. Photography and Media
11.1. Tours may be photographed or filmed.
11.2. Guests consent to the use of such media for marketing unless they request otherwise in writing.
12. Transport and Vehicle Liability (Land Rover Defender)
12.1. Tours may involve travel in a Land Rover Defender, which has a higher entry step, elevated seating and firmer suspension.
12.2. Guests must use provided steps or hand grips when entering or exiting the vehicle.
12.3. Seat belts must be worn at all times when the vehicle is moving.
12.4. Guests must remain seated while the vehicle is in motion.
12.5. Routes may include uneven or gravel roads depending on operational needs.
12.6. Sudden braking or manoeuvres may occur due to road hazards or traffic conditions.
12.7. Design Safaris accepts no liability for injuries arising from:
• failing to follow instructions
• improper entering or exiting
• not wearing a seat belt
• standing or moving inside the vehicle
12.8. Where third party transport is used, those providers are responsible for the condition, licensing and insurance of their vehicles.
13. Multi-Day Extensions
13.1. For multi-day itineraries, accommodation and external services are provided by independent partners.
13.2. Design Safaris is not responsible for accommodation quality, food safety or changes made by external providers.
13.3. Luggage is transported at the guest’s own risk.
14. Force Majeure
14.1. Design Safaris is not liable for delays, cancellations or losses caused by events beyond its reasonable control.
14.2. Refunds or credits may be offered less unrecoverable costs.
15. Governing Law
15.1. These T&Cs are governed by South African law.
15.2. Any dispute falls under the jurisdiction of South African courts.
